Under section 345A of the Bangladesh Labour (Amendment) Act, 2026, discriminatory conduct against workers on the grounds of race, religion, caste, sex, or disability has been prohibited.
Observation

As provided in the following amendment Bangladesh Labour (Amendment) Act, 2026:
“345A. Prohibition of discrimination against workers.—(1) No employer shall engage in discriminatory conduct against any worker. Explanation.—In this sub-section, ‘discrimination’ means such conduct whereby a person is distinguished, excluded, or given less importance on the grounds of race, caste, sex, gender identity, religion, political opinion, nationality, social origin, descent, or disability, and as a result the equality of opportunity and treatment in employment or occupation is destroyed.
(2) If special qualifications or skills are essential for a particular job, then a decision taken on that basis shall be deemed valid and shall not be considered discrimination.
(3) The following matters shall also not be regarded as discrimination, namely: (a) measures relating to persons reasonably suspected of, or engaged in, activities threatening the security of the State; (b) special protection or assistance measures taken for the advancement of groups socially, economically, or educationally disadvantaged due to past discriminatory laws or practices.”
